Guardianship is sometimes thought to be the only solution for families helping someone who has a disability, even though it may unnecessarily limit the individual’s decision-making ability. Sometimes people are told—even by doctors or teachers—that guardianship is necessary for individuals with disabilities once they reach adulthood (18 in Pennsylvania). While this advice may be well-meaning, it is not well-founded.

Under Pennsylvania law, there are several alternatives to guardianship that afford viable decision-making options that can often solve many issues that individuals and their families face throughout their lifetime. These alternatives are also less cumbersome, have substantially lower emotional and financial costs, and preserve more of the rights of the person with the disability than a court-ordered guardianship. This presentation will educate families about these alternatives and how they work in practice. 

At the completion of this session, learners will be able to list alternatives to guardianship of the person and the estate and explain the benefits these alternatives afford people with disabilities

Robin Resnick graduated from the University of Pennsylvania School of Law in 1986.  She has been a staff attorney with Disability Rights Pennsylvania and its predecessor organizations since 1993.  She works in many different areas of law, including addressing unnecessary institutionalization, discrimination in the areas of housing, government services, transportation, and public accommodations, access to Medicaid services, and voting rights.  Robin is familiar with Pennsylvania law regarding guardianship and alternatives to guardianship and have written briefs in several court cases on these issues.
